Mitarbeiter von Clemens Roosen (Upcrate) oder deren Angehörige dürfen nicht an der Verlosung teilnehmen. Die Teilnahme ist ab 18 Jahre möglich. Anstelle der Sachpreise kann kein Bargeld ausgezahlt werden.

Die Gewinner werden per Mitteilung unterhalb des Gewinnspielposts bekanntgegeben. Der Gewinner/ Die Gewinnerin kann sich innerhalb von sieben Tagen bei uns per Email oder Instagram Nachricht melden um den Gewinn zu beanstanden. Danach verfällt der Gewinn.

Der Gewinner erhält er einen Gutscheincode und ein Link über den er seine Adressdaten mitteilen kann. Der Versand ist kostenlos. Allerdings wird für den Versand in manche Länder, in denen Sendungen, vormals ohne Sendungsverfolgungsnummer verschwanden, eine verpflichtende Sendungsverfolgungsgebühr von EUR 2,50 erhoben, die beim Bestellprozess bezahlt werden muss. Wir werden den Gewinn an diese Adresse mit einem nationalen Versanddienstleister (Deutsche Post) versenden. Es wird keine Haftung für den Verlust, die Beschädigung oder eine verspätete Zustellung des Gewinns übernommen. Die Gewinnerdaten werden bei uns für einen Zeitraum von drei Jahren (gerechnet ab dem Schluss des Jahres, in dem die Teilnahme stattgefunden hat) gespeichert, um etwaige Rückfragen zu dem Gewinn oder der Gewinnauslosung beantworten zu können. Für die Erfüllung der vorgenannten Zwecke ist es erforderlich, die Gewinner-Daten unseren Versanddienstleister weiterzuleiten, damit diese die Gewinne transportieren können. Eine weitergehende Nutzung der Daten durch diese Kooperationspartner erfolgt nicht. Der Rechtsweg ist ausgeschlossen. Veranstalter des Gewinnspiels ist Clemens Roosen.

Das Gewinnspiel steht in keiner Verbindung zu Facebook/Instagram und wird in keiner Weise von Facebook/Instagram gesponsert, unterstützt oder organisiert. Facebook/Instagram ist an dem Gewinnspiel in keinster Weise beteiligt- und stellt lediglich die Plattform zur Teilnahme dar. Die personenbezogenen Daten werden vertraulich behandelt und werden alleine für die Zwecke des jeweiligen Gewinnspiels genutzt. Eine Einwilligung kann jederzeit mittels Mitteilung an info@upcrate.art widerrufen werden. Ferner besteht das Recht, der Verwendung Ihrer personenbezogenen Daten zu widersprechen (Art. 21 DSGVO), die Einschränkung der Verarbeitung zu verlangen (Art. 18 DSGVO), Auskunft über die gespeicherten personenbezogenen Daten oder eine Kopie hiervon zu erhalten (Art. 15 DSGVO), personenbezogene Daten korrigieren oder auf den neuesten Stand bringen, sperren oder löschen zu lassen (Art. 16, 17 DSGVO).

Im Falle eines Widerrufes bleibt die Rechtmäßigkeit der aufgrund der Einwilligung bis zu diesem Zeitpunkt verarbeiteten Daten unberührt. Die Nutzung der Daten erfolgt zu vertraglichen Zwecken i. S. d. Art. 6 Abs. 1 b) DSGVO (Gewinnspielvereinbarung) bzw. zur Wahrung der berechtigten Interessen des Anbieters i. S. v. Art. 6 Abs. 1 f) DSGVO. Auf Ihr Beschwerderecht bei der zuständigen Aufsichtsbehörde i. S. d. Art. 77 DSGVO sowie auf Ihr Recht zur Datenübertragbarkeit i. S. d. Art. 20 DSGVO werden Sie hiermit hingewiesen. Clemens Roosen (Upcrate) employees or their relatives may not participate in the giveaway. Participation is possible from the age of 18. Instead of the material prizes, cash cannot be paid out.

The winners will be announced by message below the giveaway post. The winner can contact us by email or Instagram message within seven days to claim the prize. After this period, the prize will be expired. Then the winner receives a voucher code and a link through which he can tell us his address details. Shipping is free. However, there is a mandatory tracking fee of EUR 2.50 for shipping to some countries, where parcels had been lost in the past. This fee must be paid during the ordering process. We will send the prize to this address with a national shipping service (Deutsche Post). No liability is accepted for the loss, damage or late delivery of the prize. The winner data will be stored with us for a period of three years (calculated from the end of the year in which the participation took place) in order to be able to answer any questions about the prize or the prize draw. To fulfill the aforementioned purposes, it is necessary to forward the winner data to our shipping service provider so that they can transport the winnings. These cooperation partners do not use the data further.
